EXECUTIVE SUMMARY

Through its Detection Services Licensing Program, the Tennessee Department of Commerce and Insurance has recently filed amendments to its rules governing Private Protective Services (Chapter 0780-05-02). These amendments, primarily based on a previous emergency rule and stemming from "Dallas' Law," mainly focus on training requirements and licensure fees for unarmed and armed security guards and certified trainers. Implementation of "Dallas' Law" Training Requirements:

Rule 0780-05-02-.10(6) now specifies that training related to active shooter situations can be provided by a certified trainer, a recognized/accredited program approved by the Commissioner, an individual training program deemed sufficient by the Commissioner, or applicable law enforcement training approved by the Commissioner.

Tennessee Code § 62-35-118(e) mandates active-shooter training (at least 8 hours) for armed security guards or officers providing services in public, charter, private, or church-related schools.

Redefinition of "Employed": The definition of "Employed" is amended to mean "to receive compensation, in any form, for the performance of security guard services and/or patrol services."

Application Denial and Reapplication: Rule 0780-05-02-.08(f) clarifies that if a security guard registration is denied based on a criminal record, the individual must cease all security guard activities immediately and cannot reapply for six months.

Pending Applications in Schools: Security guards/officers working on pending applications in schools must always carry proof of all necessary training requirements on their person (Rule 0780-05-02-.08(g)).

Examination Administration: Examinations for new registration cards will now be administered and graded by the applicant's certified trainer (Rule 0780-05-02-.09(1)). These exams should focus on general security knowledge, not specific company policies, and are subject to Commissioner review.

FEES INCREASE 

Tennessee Private Protective Services Fee Changes Effective June 19, 2025

Rule 0780-05-02-.23 outlines increases in application and renewal fees for security guards and certified trainers. The new security guard fee increases outlined in Rule 0780-05-02-.232 are set to take effect on June 19, 2025. Below is a summary of the updated fees:

Armed Security Guard:

- The application fee has increased from $75 to $100 plus any fingerprint processing fees

- The registration fee remains at $30.

Total (Old) $105, plus any fingerprint processing fees

Total (New) $130, plus any fingerprint processing fees

 Armed Renewal:

- The timely renewal fee has been raised from $60 to $85

- The late renewal penalty remains $20 monthly for up to three months.

Unarmed Security Guard:

- The application fee has increased from $50 to $75, plus any fingerprint processing fees

- The registration fee remains at $20

Total (Old) $70, plus any fingerprint processing fees

Total (New) $95, plus any fingerprint processing fees

Unarmed Renewal:

- The timely renewal fee has increased from $50 to $70

- The late renewal penalty remains $20 monthly for up to three months.

Other Fees:

- The fee for a duplicate certification, license, or registration is $25

New Fees:

- The application fee for adding classifications (e.g., Dallas Law and Active Shooter) to a security guard registration card is a nonrefundable $25\

CHANGES IN THE LICENSURE & APPLICATION PROCESS

Additionally, the rule clarifies that individuals changing their registration status from unarmed to armed or vice versa must complete a new application and pay all applicable fees. 

The rationale for these increases is to "maintain the statutorily required financial self-sufficiency of the Program."

Regulations Regarding Sworn Peace Officers:

Rule 0780-05-02-.03 is amended to clarify that while the Act doesn't apply to full-time sworn peace officers receiving compensation as security guards under contract with licensed private businesses or registered proprietary organizations, this exemption does not relieve the companies or organizations themselves from the Act's requirements (e.g., registration or licensing).

Authorized Weapons:

The definition of a "Stun gun" has been updated to specify that it is "designed and manufactured for self-defense which emits an electrical spark which may momentarily disable a person."

Rule 0780-05-02-.15(1)(c) is strengthened to explicitly state that no security guard/officer shall carry a firearm while acting in that role unless adequately registered and certified, regardless of whether they possess a handgun carry permit as a private citizen. The previous rule had a similar intent, but the new language is more direct.

The list of approved firearm calibers remains largely the same, including standard .38 special, 9mm, .45 ACP, and 12-gauge shotgun, with the addition of ".357 SIG" and ".40 S&W" to the specific examples.

Changes of Address and Employer:

Rule 0780-05-02-.16(2) is amended to require registrants to notify the Commissioner in writing within ten (10) days of any change in residential address. The requirement to notify of a change in employer has been removed in this amendment.

Investigations and Complaints:

Rule 0780-05-02-.18(3) is added, requiring any licensee, registrant, or entity subject to T.C.A. § 62-35-142 to maintain a guard roster and provide it upon request by the Commissioner. Failure to do so violates T.C.A. § 62-35-130(a)(11). This adds clarity to what constitutes non-cooperation during an inquiry. 

GUARD ROSTER REQUIREMENT

Loss prevention is a standard part of the operations of more prominent brands and chain stores, but the smaller independent sites often neglect it. Unfortunately, shoplifting in these locations is an increasing issue that cannot be avoided for long – the impact on the bottom line for a small business owner can be devastating. 

Here are five cost-effective options for improving the security of your store with a fast return on investment. 

1: Convex Security Mirrors 

A convex mirror is a reflective surface that curves outward toward the person looking into it. This allows for a broader field of view, which makes it the perfect tool for the small store owner –install the mirror where you can see it from the register and where the enlarged viewpoint covers any ‘blind spots.’ In this way, you can effectively monitor what is happening behind racks or in aisles that you cannot typically easily monitor – allowing you to spot shoplifters. 

The mirror and most of our security measures also act as a deterrent. Your typical shoplifter will look for an unobserved place where they can bag or pocket the items they plan to steal, and seeing the mirror will let them know they are being watched. 

2: Security Camera Systems

Security cameras are more affordable than ever, with entire systems and software now under the price of a single camera just a handful of years ago. Cameras are a great option, as they can be used as a live monitoring tool (similar to the convex mirror) and as a recording device to prove a crime if necessary. 

Be sure to place cameras so the store is effectively covered, and you can track shoplifters easily. You can also use the recorded footage to review particular periods – so even if you do not notice a shoplifter as they commit their crime, you will know who to watch out for next time. In many cases, a ‘successful’ shoplifting event will encourage the criminal to come back and try again – so make a note of who to look out for. 

You can find security camera systems that record locally and use cloud storage, in a range of definitions and various other features – so you will need to research what type of system you prefer carefully and would work within your store. 

3. Security Tags

Security tags are typically used in clothing stores and work in tandem with a radio frequency monitoring system. In brief, you will have a monitor installed around the doors of your store, with which all of your security tags will communicate. An alarm will sound if an item leaves the store, or more specifically, the tag leaves the store. 

These tags are affixed to your stock before they are displayed for purchase and quickly removed at the cash register. While they are easy to take off with the correct magnetic equipment (very little training required),they are challenging for the shoplifter to take off. If an individual does manage to take the item out of the store without triggering the alarm, they will still be left with an item of clothing that has the tag attached – and are likely to damage their stolen goods while trying to remove it. 

4: Security Labels 

A security label is operated similarly to a security tag but is designed to be affixed to a broader range of product types. The label is a sticker that can be applied to non-clothing consumer goods, including books, cosmetics, and groceries. 

Another key difference between security tags and security labels is that the tag is removed at checkout and can be reused, whereas a security label is deactivated and left on the item. As these are single-use security products, many store owners only use them on high-risk or high-value products – packs of steak rather than chips, for example. 

5: Security Guards 

Having a security guard on-site is an excellent two-pronged approach to reducing losses through shoplifting. The guard can patrol the store, paying particular attention to blindspots and areas where high-risk items are stocked, and provides a physical deterrent that far out-performs other types of security measures. Shoplifters may see a camera and attempt to find a way to steal that takes advantage of its position or the direction it is pointing – a security guard can be infinitely more flexible and attentive, making staff (and you) feel safer at work. 

The key, however, is ensuring the security guard is trained correctly. If an untrained person is used for security purposes, then there is an increased risk of a host of ethical or legal issues – including the use of excessive force, improper detention, or profiling based on race, age, or gender, for example. 

Hiring a security guard is an ongoing operational cost instead of the one-off price of buying and installing a convex mirror (for example). You can mitigate this cost somewhat by only having the personnel on-site in particularly high-loss periods – around holidays, weekends, evenings, etc. Assess when you incur the most loss and work out a schedule accordingly – remember, as long as your reduced losses exceed the cost of the guard, you are profiting.

Working as a private security guard in a place that serves alcohol can be challenging, especially when dealing with drunk and hostile customers. Here are ten effective de-escalation strategies to help you manage these situations safely and professionally: 

1. Stay Calm and Professional: 

Maintaining a calm and professional demeanor is crucial, even in the face of an agitated or aggressive customer. This sets a positive tone for the interaction and can help defuse the situation. Maintaining composure demonstrates empathy and understanding, making customers feel heard and respected. A professional demeanor instills confidence and trust, making customers more receptive to solutions. Remaining calm lets you think clearly and respond thoughtfully, avoiding further escalation. Staying professional helps uphold the organization's reputation and fosters a positive customer experience. 2. Listen Actively:

4. Use Non-Verbal Communication: 

Non-verbal communication is essential to create a positive impression and convey your message effectively. Making eye contact shows that you are engaged, attentive, and confident. Aim for 60-70% eye contact during a conversation. Use open body language. Keep your body relaxed and open, with your arms uncrossed and your shoulders back. This indicates that you are open to communication and receptive to what the other person says. Keep a safe distance. Maintain a comfortable and respectful distance from the other person. This will help put them at ease and create a sense of personal space. 

5. Avoid Arguing or Debating: 

Refrain from arguing or debating with the customer, as it can escalate the situation. Listen attentively to their concerns and try to understand their perspective. Acknowledge their feelings and show empathy. Focus on finding a mutually agreeable solution rather than trying to prove who is right or wrong. If the customer becomes agitated or unreasonable, move people to a safer area while gaining a better tactical position and inform fellow security team members. 

6. Offer Alternatives: 

Provide options or solutions to address customer concerns. Present a variety of choices that suit different needs, preferences, and budgets. Explain the pros and cons of each alternative to help the customer make an informed decision. Be open to customization and tailoring solutions to meet specific requirements. Offer upgrades or add-ons to enhance the value of the proposed alternatives. Provide a clear comparison of the other options to enable easy decision-making. Consider the customer's feedback and incorporate their suggestions into the proposed alternatives. Remain flexible and willing to adjust to different options based on changing circumstances. Provide additional information or resources to support the customer's evaluation of the possibilities. Maintain a positive and solution-oriented approach throughout the process. 

7. Set Clear Boundaries: 

Politely but firmly set boundaries and explain the consequences of inappropriate behavior. This can be done verbally, calmly, and respectfully. Remember that an escalated person can need up to five times the distance compared to a casual encounter with a stranger. You should give them more space and avoid sudden movements or gestures. If the person does not respect your boundaries, you should take further action, such as asking them to leave or calling the police. It's important to remember that setting boundaries is not about being rude or dismissive but protecting yourself and others from harm. By setting clear boundaries, you can help to create a safe and respectful environment for everyone. Some examples of clear boundaries you can set include: You are not tolerating verbal or physical abuse. You are not allowing people to touch you without your consent, not allowing people to make you feel uncomfortable or unsafe, and not allowing people to enter your personal space without your permission. You are not allowing people to make offensive or discriminatory remarks towards bystanders and other customers; however, do not take the insults hurled at you by a drunk or hostile person personally. 

8. Assess the Situation: 

Security guards must first assess the severity of the situation. If there is a risk of physical harm, property damage, or a threat to public safety, immediate action is necessary. Security guards play a crucial role in maintaining order and ensuring the safety of individuals and property. When faced with an emergency, security guards must assess the situation promptly and take appropriate action. The first step involves evaluating the severity of the problem. Here are some key factors that security guards should consider during their assessment: 

Risk of Physical Harm: 

Determine if there is an immediate threat of physical harm to individuals. Assess the number of individuals involved and their proximity to the potential danger. Evaluate the potential for escalation and the presence of weapons. 

Threat to Public Safety: 

Evaluate the potential for the situation to affect the public's safety. Assess whether the problem could lead to panic, confusion, or a disruption of everyday activities. Determine if there is a need to evacuate or secure the area. 

Immediate Danger: 

If there is an immediate threat to life or property, security guards must take immediate action to mitigate the risk. This may involve calling for backup, contacting law enforcement, or physically intervening to prevent harm. The level of force should be equal to or only slightly more significant than the aggressor's. During physical altercations, continue to use verbal de-escalation commands throughout the process, including, "Stop hurting me!", "Stop!" or "Leave!" or emphasizers such as "Now!" or "Quit!" 

Security officers must intervene when unnecessary or excessive force is being used.
